Side Effects of Lipitor

Lipitor (atorvastatin calcium) is a prescription medicine that comes in tablet form. Lipitor is a statin, which is a type of cholesterol lowering medicine. Statins work by blocking an enzyme in the liver that makes cholesterol. This reduces overall cholesterol levels in the body.

Is there a Lipitor Class Action or MDL?
While numerous Lipitor cases have been filed and continue to be filed, there is currently no class action for Lipitor side effects. Instead of creating a class action lawsuit, plaintiff lawyers have filed a motion to consolidate all federal Lipitor cases with similar claims into an MDL (multi district litigation).
MDLs are similar to class actions, in that, if instituted, all cases will be tried in front of the same judge in the same district court. However, MDL cases are tried on an individual basis. Each case will have a separate trial, as opposed to class action lawsuits, where all plaintiffs’ claims are represented in one case. In class action lawsuits, all the plaintiffs split a single award and the compensation each plaintiff receives is not in any way reflective of each plaintiff’s actual damages. Since MDL lawsuits are tried separately, there is a greater likelihood of plaintiffs in an MDL receiving adequate compensation for their injuries than in a class action suit.
Due to an increased number of lawsuits pending against the maker of Lipitor, Pfizer, the plaintiffs have moved to coordinate the cases to multidistrict litigation. Although the location of the Lipitor MDL has not yet been determined, one such possible jurisdiction is the New Orleans, Louisiana. The U.S. Judicial Panel on Multidistrict Litigation announced that oral arguments for selected Lipitor lawsuits will begin on Jan. 30, 2014. At this hearing, the court will review 56 lawsuits pending in federal courts throughout the nation that allege Lipitor side effects caused women to develop type-2 diabetes.
